These Terms and Conditions set out the basis on which Rubbish Removal Barnes provides rubbish removal, waste collection, clearance and related services to residential and commercial customers in the United Kingdom. By making a booking, confirming a quotation or allowing our operatives to commence work at your property, you agree to be bound by these Terms and Conditions.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Service means any rubbish removal, waste collection, waste clearance, bulky item removal, garden waste removal, construction waste removal or related service provided by us.

2. Scope of Service

The exact scope of the Service, including the type and approximate volume of Waste to be removed, access arrangements and any special requirements, will be agreed with you before the Service is carried out.
We reserve the right to refuse to carry out all or part of the Service if:
It would be unsafe or unlawful to do so.
The Waste includes prohibited items or substances.
The access to the Property is significantly different from that described at the time of booking, or is unsafe for our operatives or vehicles.
3. Booking Process
You may request a quotation and make a Booking by telephone, email or via any online or digital booking method we offer from time to time. When requesting a quotation, you must provide accurate and complete information regarding:
The location of the Property.
The type, approximate quantity and nature of the Waste.
Access restrictions, such as limited parking, height restrictions, stair access only or controlled parking zones.
Any time restrictions or special requirements.
In some cases, we may provide an initial estimate based on your description, photographs or videos supplied by you. Final pricing may be confirmed on arrival once our operatives have inspected the Waste and assessed access and loading conditions. If the revised price is not acceptable to you, you may cancel the Service at that stage, subject to any applicable call-out or attendance charge notified to you in advance.
A Booking will be treated as confirmed when we have agreed a date and, where applicable, a time window for the Service, and you have accepted our pricing and any specific conditions relating to that Booking.
4. Access and Parking
You are responsible for providing safe and reasonable access to the Property for our operatives and vehicles. This includes ensuring that:
Any necessary parking arrangements are in place, such as visitor permits, pre-paid parking or loading bay access.
There are no obstacles that would prevent safe access to the Waste.
Any gates, doors or security systems can be operated or opened at the agreed Service time.
Where parking fees, congestion charges or similar charges apply, these may be added to the price of the Service or charged as a separate cost, as confirmed at the time of Booking or on arrival.
If we are unable to carry out the Service or experience significant delays because access has not been arranged or is unsafe, we may charge a waiting fee, an aborted visit fee or a revised Service fee, depending on the circumstances.
5. Pricing and Quotations
Our prices are generally based on the volume, weight and type of Waste, the labour involved and any additional charges such as parking, special handling or disposal fees for specific materials. All prices will be provided to you before the Service is carried out.
Any quotation or estimate we provide is based on the information you supply and is not binding if the actual Waste or conditions differ materially from your description. In such cases, we will provide a revised price before proceeding. If you do not accept the revised price, we may cancel the Service and, if applicable, charge for our time and travel to the Property.
All prices are in pounds sterling. Where applicable, VAT or other taxes will be applied in accordance with UK law and will be clearly shown to you.
6. Payments
Payment terms will be confirmed at the time of Booking and may differ for residential and commercial customers.
For most residential customers, payment is due immediately on completion of the Service. We may accept payment by cash, card, bank transfer or other methods notified to you.
For commercial customers, different payment terms may apply, such as payment within a set number of days from the date of invoice. Any such arrangements must be agreed in advance.
We reserve the right to require part or full payment in advance, particularly for larger clearances or where specialist equipment is required.
If payment is not made when due, we may charge interest on overdue sums at the statutory rate and may take reasonable steps to recover outstanding amounts, including legal action where necessary.
7. Cancellations and Amendments
You may cancel or amend your Booking by contacting us by telephone or email. The following conditions apply unless we have agreed otherwise in writing:
If you cancel more than 24 hours before the agreed Service time, no cancellation charge will usually apply.
If you cancel within 24 hours of the agreed Service time, we may charge a cancellation fee to cover our administrative and scheduling costs.
If our operatives attend the Property at the agreed time and are unable to complete the Service due to circumstances within your control, such as failure to provide access, failure to arrange parking or a change of mind on arrival, we may charge an attendance or aborted visit fee.
If you wish to amend the time, date or scope of the Service, we will try to accommodate your request, but this cannot be guaranteed. Changes may result in price adjustments and, if the Service cannot be rescheduled within a reasonable timeframe, may be treated as a cancellation.
8. Customer Responsibilities
You are responsible for:
Ensuring that you have the authority of the property owner or occupier to arrange the Service.
Identifying and clearly indicating the Waste to be removed.
Notifying us of any hazardous materials, sharp objects, fragile items or any risks at the Property.
Ensuring that the Waste does not include any items prohibited under these Terms and Conditions or under UK waste regulations.
You must not request us to remove any items that you do not have the legal right to dispose of, such as items belonging to third parties without their consent.
9. Waste Regulations and Prohibited Items
We operate in compliance with applicable UK waste management and environmental regulations. All Waste collected by us will be transported and disposed of at authorised facilities or by licensed partners, in accordance with the law.
Certain items and materials may be hazardous, regulated or prohibited from collection or may require special handling. These may include, but are not limited to:
Asbestos and materials containing asbestos.
Chemicals, solvents, oils, paints and industrial liquids.
Clinical or medical waste, syringes and pharmaceutical products.
Gas bottles, fuel containers and pressurised cylinders.
Explosives, firearms or ammunition.
Radioactive materials.
If you are unsure whether particular Waste can be collected, you must inform us before the Service begins. We may refuse to collect any items that we reasonably believe cannot be carried, transported or disposed of safely and legally.
We may, at our discretion, arrange specialist disposal for certain regulated items where lawful, but additional charges will apply and must be agreed in advance.
10. Service Performance and Timeframes
We will use reasonable efforts to attend the Property and complete the Service within the agreed time window. However, all times are estimates, and we cannot guarantee arrival or completion times due to factors such as traffic, weather, access issues or delays at previous jobs.
If we anticipate a significant delay, we will try to notify you as soon as reasonably practicable and agree an alternative time or date where necessary. We will not be liable for any indirect loss, loss of earnings or other consequential loss arising from delays, except as cannot be excluded by law.
11. Liability and Damage
We will carry out the Service with reasonable care and skill. However, minor scuffs, marks or wear and tear may occur where large or heavy items are removed from confined spaces, narrow corridors or staircases. You should take reasonable steps to protect floors, walls and surfaces where you consider them to be at particular risk.
We will not be liable for:
Pre-existing damage to your property or items.
Damage that occurs as a result of defective or weak structures, fixtures or fittings, such as loose floorboards or fragile plaster.
Loss of any item that you did not clearly identify as not to be removed or which was mixed with the Waste to be collected.
Our total liability for any loss or damage arising from the Service, whether in contract, tort or otherwise, shall be limited to the price paid or payable for the Service, except where such limitation is not permitted by law. Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or for any other liability that cannot be excluded under UK law.
12. Insurance
We maintain insurance cover appropriate to our business activities, which may include public liability insurance and, where applicable, employer liability insurance. Details of our insurance cover can be provided upon reasonable request.
13. Title and Responsibility for Waste
Once the Waste has been loaded onto our vehicle, it becomes our responsibility and, where applicable, our property. We will then transport and dispose of the Waste at authorised facilities in accordance with applicable UK waste regulations.
Until the Waste is loaded onto our vehicle, you remain responsible for it and for any risk associated with its presence at the Property.
14. Data Protection and Privacy
We may collect and process personal data, such as your name, contact details and Property address, for the purposes of managing bookings, carrying out the Service, issuing invoices and handling enquiries or complaints. We will handle your personal data in accordance with applicable data protection laws in the United Kingdom.
Your information will not be sold to third parties. It may be shared with trusted partners where necessary to perform the Service, process payments or comply with legal obligations.
15. Complaints
If you are dissatisfied with any aspect of the Service, you should contact us as soon as possible, providing details of your complaint and any relevant information. We will aim to investigate and respond within a reasonable time and, where appropriate, may offer a remedy such as a partial refund, repeat visit or other resolution, at our discretion and subject to applicable law.
16. Force Majeure
We will not be liable for any failure or delay in performing our obligations under these Terms and Conditions where such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to extreme weather, accidents, road closures, strikes, acts of war, terrorism, civil disturbance or failure of utilities.
17. Changes to These Terms and Conditions
We may update or amend these Terms and Conditions from time to time. The version in force at the time of your Booking will apply to that Service. Continued use of our services after changes have been published or notified to you will constitute acceptance of the updated Terms and Conditions.
18. Governing Law and Jurisdiction
These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the Service provided by Rubbish Removal Barnes, shall be governed by and construed in accordance with the laws of England and Wales.
Both you and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service, except where applicable consumer law permits you to choose a different jurisdiction.
19. Severability
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed severed from the remaining provisions, which shall continue to be valid and enforceable to the fullest extent permitted by law.
20. Entire Agreement
These Terms and Conditions, together with any written confirmation or quotation provided by us and accepted by you, constitute the entire agreement between you and Rubbish Removal Barnes in relation to the Service. You acknowledge that you have not relied on any statement, promise or representation that is not expressly set out in these Terms and Conditions.
